Judge Rules Against Obama Objectors

An effort to have President Barack Obama's name removed from New Jersey's primary ballot was dealt a setback following an administrative judge's recent ruling.

In what attorney Mario Apuzzo is calling a "sham of justice," a state judge has ruled against objectors seeking to remove President Barack Obama's name from New Jersey's upcoming primary ballot .

According to Apuzzo, the attorney representing , Deputy Director and Administrative Law Judge Jeff Masin ruled against the ballot challenge following a more than three-hour hearing earlier this week. His decision, delivered to Apuzzo via email, was not based on the issues presented in the challenge, namely that Obama is not a natural born citizen of the United States and that a birth certificate released by the White House last April is fraudulent, but rather on a technicality, Apuzzo said.

The judge ruled that Obama's place on the ballot could not be removed by challenge because Obama, as president, automatically appears on the ballot and without his consent. Thus, Obama cannot be held immediately responsible for proving his eligibility. Apuzzo filed an exception and the matter was passed along to New Jersey Secretary of State Kim Guadagno who will have to make the final determination at this stage.

Should Guadagno uphold the court's decision, Apuzzo said he would file an appeal.

"The sham continues. In one way or another it's a sham of justice. Our judiciary is really taking us for a ride," Apuzzo said during a telephone interview Thursday. "How can they expect us to do something that the law doesn't allow for (challenging Obama's place on the ballot)? The logic is unbelievable."

Purpura, of Wall Township, and Moran, a Toms River resident, filed a challenge alleging that Obama has both failed to show proof that he was born in the U.S. and is not a natural born citizen because both of his parents are not U.S. citizens. According to the Constitution, Apuzzo charges, Obama is ineligible to serve as the country's president and should not appear on the state's June 5 primary ballot.

Obama was represented by Alexandra Hill of the Newark-based law firm Genova, Burn and Giantomasi.

What struck Apuzzo, he said, was not just the judge's decision, but a concession made by Hill that the court has no documented evidence of Obama's birth. Armed with a number of witnesses, including an expert who was willing to testify that Obama's birth certificate, posted online in April 2011 by the White House, was fraudulent, Apuzzo was instead told to holster his guns.

"We were willing to present that what's online has been manipulated by computer, human, or both and that it's not reliable. I told them I was ready to prove that and if they didn't want this witness to testify then concede that," he said. "I got Obama (Obama's attorney Hill) to concede that there is no evidence before the court as to his place of birth, which includes what's on the internet."

Though the judge ruled the Obama isn't required to prove his ballot eligibility, Apuzzo considers the concession a win of sorts, one he hopes will help his case gain traction should it appear before an appellate court. He stressed that he's willing to go as far as he can to prove that Obama does not belong on the state's ballot. Should that mean taking the case to the State Supreme Court or the U.S. Supreme Court, Apuzzo said he's ready.

Wow! Purpura (a type of skin rash), Moron--oops! Moran, represented by their lawyer, a- putz-o--er Apuzzo lost their case in the court of common sense. They should be billed for their waste of taxpayers dollars in bringing this case, and Apuzzo should be disbarred for his lack of common sense and his offense in wasting the time of the legal system of this state. Lol! Apuzzo said he could provide an "expert who was willing to testify that Obama's birth certificate, posted online in April 2011 by the White House, was fraudulent." I betcha he could also find at least a hundred "experts" that are willing to testify that Obama is actually a space alien. To allow Obama's name on the N.J. and other Ballots is subourning a FRAUD!For this Judge to rule otherwise is ludicrous and in itself a violation of his own OATH of OFFICE to support and Defend our Constitutions (USA & N.J.) Every Document Obama submitted is a Forgery! His background is invented and his alleged School records sealed. WHY? Many Videos exist that show Obama bragging about not being born i n the USa but Kenya! The MSM ignores them. Rik, You have to understand...the left has no standards. They like it that way because they remain a moving target. The press covered for JFK in a time that his infidelities would have sunk his presidency. More recently the great stain-maker, Bill Clinton had almost every lib running interference for him. Poor Paula Jones was the only one to hold his (bleep) to the fire and he had to shell out $800,000 and forced him to lie under oath. But he is the exception. The First Kenyan is on his way out and when he is they'll all of a sudden find all the missing pieces to his most improbable puzzle. The happiest man in America(next to us) will be Jimmy Carter. And this fraud will begin the next several decades as a pariah. It was three presidential cycles before they let Jimmy Carter anywhere near a convention. If he didn't develop his only real skil,l hammering nails, he's still be on the outside looking in. He still hasn't fully made his way back...remember they forced him to sit next to Michael Moore at the convention. And they say Chris Christie is fat.

It is pretty sad that the best the republicans could come up to run against “the Kenyan” is Mitt Witt, a Mormon moron. Well, it could have been worse. Thankfully they did pass over Palin, Bachman and Gingrich. Someday the Republican Party will ditch its infatuation with fruit loops and return to its centrist roots.

Ric, I just with the First Kenyan would come clean and put this all to bed. Here a publicist says he was born in Kenya. What's the big deal in telling the truth? I've seen him in his Muslim garb and he looks more at home than in a suit. He does have that slim build that many Kenyan runners have. They always win the marathons. I think a lot of Kenyans used to follow bees back to their hives, that's how they got so good. I wish this one would run back to his hive(Chicago). ;-)

MacArthur, Why doesn't someone just ask the First Kenyan about it? You have to admit what with all the hubbub that this is just another thing that fosters these conspiracy theories. Would you bet all your assets(I'm sure that's not very much) that borat isn't really a Kenyan? I know I wouldn't. The democrats were so anxious to win one for once that they probably didn't check. Speaking of which, I read something the other day that kind of relates. It said that historians went back to all the presidential elections since woman got the vote and it was determined had that great mistake(kidding) not been made...no democrat would have ever been elected. I blame all those mistakes on them. I think what with the women and the democrat men(and their low or absent testosterone) this makes total sense. That goes along with my belief that during Clinton most democrat women wished they were Monica. And most democrat men did too.

Admit what, that people are crazy and nothing's new? There are these things called official government documents - you know, like, say, a Hawaii-issued birth certificate - that actually carry weight and mean something. Never mind that his mom was undoubtedly a citizen, which makes him one automatically - just like one Senator McCain, who was unquestionably born outside the good ol' U.S. of A., unlike our President. If you want to believe the President is Kenyan, go right ahead. I'm sure the aliens who we caught at Roswell will agree with you, if no one else. They might actually have some respect for the office, unlike you, though.

MacArthur, Government documents? Do you know how many illegals are walking around with "government documents"? Don't get me started. What's your theory on this latest document that claims borat's a Kenyan? You must have a theory. Do you think Obama was just lying to enhance his resume? Were they trying to create some buzz for an affirmative action president of the Harvard Law Review? I just find it strange that this folder just comes out and says he's a Kenyan and this just happens to be about someone who people have said, is one. I don't think it much matters at this late date but you have to admit it seems strange. He'll be out soon so none of this will be important but the truth is the truth.
